Massachusetts is a “no fault” divorce state. This means that spouses may dissolve their marriage without having to prove which of them is to blame. Instead, couples may end their marriage by simply arguing that there has been an “irretrievable breakdown” of the relationship. Typically, a Motion for Temporary Rulings will be filed shortly thereafter. The Court will enter a temporary ruling as to what each party’s obligations will be while the case is pending. Discovery, the process by which information is gained from the other side, will then begin. If an agreement cannot be reached then the case will proceed to trial at which a Probate and Family Court Judge will hear the evidence and issue a ruling.
